These Terms & Conditions (“Terms”) govern access to and use of HeartNotes and its digital personalized-surprise services, including https://myheartnotes.in/ and occasion-specific services such as https://birthday.myheartnotes.in/ (together, the “Service”). By accessing or using HeartNotes, you agree to these Terms.

HeartNotes is a digital service and not a physical-goods store.

You must provide information that is accurate enough for the Service to function, and you must use HeartNotes lawfully. Where required by applicable law, use of the Service by a minor should occur with appropriate parental or lawful authorization.

You must not use the Service to:

• engage in unlawful activity;
• impersonate another person;
• interfere with the Service;
• attempt unauthorized access to the Service or related systems;
• distribute malware or other harmful code; or
• abuse or exploit the platform.

HeartNotes supports guest creation for applicable experiences, including Birthday. Account creation is not mandatory to start a supported creation flow — you may create a supported HeartNote without signing up, or optionally create or use an account.

Where you create or use an account, you are responsible for keeping your account credentials and verification information secure, and you must not knowingly provide someone else's login credentials. HeartNotes may apply verification controls to access an account.

You may create personalized digital experiences using the features available on HeartNotes. Depending on the product flow, a HeartNote may include messages, photos, voice recordings, occasion details, themes or designs, personalization information, and recipient information.

Available features may vary by occasion or product version. HeartNotes does not guarantee that every feature will always be available.

You are solely responsible for content you upload, submit, or include in a HeartNote, including photos, messages, voice recordings, names, and other media. You confirm that you have the necessary rights, permissions, and authority to use and share that content.

You must not upload or use content that:

• infringes copyright, trademark, privacy, or publicity rights;
• is unlawful;
• is abusive, threatening, or harassing;
• contains malware;
• is sexually exploitative or otherwise prohibited by law;
• is intended to defraud or deceive; or
• otherwise violates applicable laws.

HeartNotes may remove content or suspend access where reasonably necessary to protect the platform, users, or to comply with law.

A HeartNote may be shared using a link or QR code, and a recipient may be able to access it without creating an account. You are responsible for sharing access only with people you intend to receive it.

Because anyone who obtains a shareable link or QR code may potentially access the corresponding HeartNote, avoid placing information in a HeartNote that you do not want exposed to someone holding that access link.

HeartNotes provides digital experiences. No physical item is shipped unless a future feature explicitly provides otherwise.

The Service may depend on internet connectivity, supported browsers or devices, third-party infrastructure, cloud or storage services, payment providers, and communication services. HeartNotes does not guarantee uninterrupted or error-free availability.

Applicable HeartNotes purchases may require payment. Payment information is processed through payment providers such as Razorpay. HeartNotes does not store your full card number, CVV, UPI PIN, or similar sensitive payment credentials on its own systems.

Orders are subject to the payment, cancellation, and refund terms that apply to the relevant service.

Where a product or service is offered for payment, the applicable price and important purchase information will be displayed before you confirm the purchase. HeartNotes may correct obvious pricing or information errors before accepting an order where legally permitted.

Cancellations and refunds are governed by our Refund Policy. A refund request may be assessed according to the applicable service status and the published Refund Policy.

HeartNotes owns or licenses its website, branding, software, design, original graphics, text, and other platform materials, unless otherwise stated. You retain ownership of content you upload, subject to any rights needed by HeartNotes to operate the Service.

By uploading content, you grant HeartNotes the limited rights necessary to host, store, process, display, transmit, and provide the requested HeartNote service.

You must not copy, reproduce, reverse engineer, resell, or otherwise exploit HeartNotes' platform materials except as permitted by law.

You grant HeartNotes a non-exclusive, limited license to process content you submit solely as reasonably necessary to provide, maintain, secure, and support the requested service.

HeartNotes may depend on third-party services such as payment providers, hosting/infrastructure providers, authentication providers, analytics providers, and communication providers. Third-party services may have separate terms and policies. HeartNotes is not responsible for independent third-party services to the extent permitted by law.

HeartNotes may add or remove features, modify designs, change available occasions, suspend features temporarily, or discontinue a feature. Reasonable notice may be provided where appropriate.

HeartNotes may suspend or terminate access where reasonably necessary if you violate these Terms, misuse the platform, are suspected of fraudulent or abusive behavior, if required by law, or where necessary to protect HeartNotes or other users. Where appropriate, you may contact support to raise a concern.

The Service is provided subject to applicable law. HeartNotes does not guarantee that the Service will be error-free, uninterrupted, permanently available, compatible with every device or browser, or immune from security incidents.

To the maximum extent permitted by applicable law, HeartNotes is not liable for indirect, incidental, or consequential loss arising from your use of the Service. Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded.

To the extent permitted by applicable law, you may be responsible for losses arising from your unlawful use of the Service, infringement of third-party rights, or violation of these Terms.

Personal information is handled according to our Privacy Policy.

These Terms are governed by the applicable laws of India. Subject to applicable law, disputes will be subject to the appropriate courts or tribunals having jurisdiction in Delhi, India.

HeartNotes may update these Terms from time to time. Material updates may be communicated through the website or other appropriate notice, and the effective date above will be updated when these Terms are materially revised.

HeartNotes
